Regulation of second-hand vehicle and real estate sales
The regulation regarding the sale of second-hand vehicles and real estate was published in the Official Gazette. The regulation will prevent advertisements from being placed through fake accounts. Individuals will not be able to place advertisements for vehicles and real estate that do not belong to them or their first or second degree relatives. Those who act contrary to the legislation will be subject to administrative fines ranging from 10 thousand TL to 100 thousand TL. The Regulations regarding the amendments to the Regulations on the Trade of Second-Hand Motor Land Vehicles and Trade in Real Estate were published in the Official Gazette. According to the said regulation amendments; those who want to place advertisements for second-hand motor land vehicles or real estate on advertisement sites will not be able to place advertisements through fake accounts where they hide their clear identities. It is prohibited to place advertisements for real estate or vehicles that do not belong to the person, their spouse or first and second degree blood relatives or for which the owner of the real estate or vehicle in question is not authorized. However, real estate agents and car dealers will be able to post the vehicle or real estate they are authorized to sell by verifying with the authorization documents they have. With the new regulation, real or legal persons providing electronic media for advertisements for the sale of second-hand motor vehicles and real estates will be obliged to verify their identity before membership or publication of the advertisement, as well as verify that they are authorized to advertise the second-hand motor vehicle or real estate subject to the advertisement before publication of the advertisement. With the changes to be made to the aforementioned regulations, administrative fines ranging from 10 thousand Turkish Lira to 100 thousand Turkish Lira will be imposed on those who act contrary to the legislation for each violation. The statement made by the Ministry of Trade regarding the said regulation changes stated, "Recently, it has been observed that our citizens are being victimized in the real estate and second-hand motor land vehicle trade through advertisements that do not reflect the truth, include price inflating and deception on advertisement websites, and upon the notification of increasing complaints in this regard, it has become necessary to amend the Regulation on Real Estate Trade and the Regulation on Second-hand Motor Land Vehicle Trade in order to eliminate the said unethical and wrong practices and victimizations. The said amendments aim to prevent fake advertisements that may cause consumer victimization, to prevent speculative price increases and to prevent advertisement pollution and information pollution in advertisements on advertisement platforms that provide services in the electronic environment."
