Urban transformation law is in force
The law containing regulations regarding urban transformation was published in the Official Gazette. The “Law on the Transformation of Areas under Disaster Risk and Amendments to Certain Laws and the Decree Law No. 375”, which includes regulations regarding urban transformation and was accepted by the TBMM General Assembly, was published in the Official Gazette. The law aims to accelerate the judicial processes regarding buildings that cannot be demolished due to requests for the cancellation of demolition decisions in earthquake zones. Within the scope of the law that allows the determination of risky structures to be made ex officio by the Urban Transformation Presidency or the administration, the owners will be given a period of not more than 90 days at a time to have risky structures demolished. The evacuation of the structures will be carried out by law enforcement in case of prevention. Urban transformation can be carried out based on the decision taken by the owners with a simple majority. The building permit will be issued within 30 days provided that the implementation zoning plan and all kinds of technical responsibilities such as architecture, statics, installations are undertaken by the Urban Transformation Presidency and the ownership is documented. It will be possible to appoint experts who meet the minimum requirements but are not included in the relevant regional expert lists.
